1. Agreement and eligibility
By accessing the service, creating an account, or ordering work, you agree to these Terms. You must be at least 18 and able to bind yourself or the organisation you represent. A signed proposal, order form, or statement of work may contain additional project terms; if they conflict, the project-specific document controls for that project.
2. Our services
TempoWeb Studio provides website design and development, digital systems, automation, hosting coordination, domain and email setup, maintenance, and related professional services. Scope, price, delivery estimates, acceptance criteria, revisions, and included support are defined in the applicable offer or project agreement. Dates are estimates unless expressly agreed as fixed.
3. Accounts and connected services
You are responsible for accurate information, safeguarding credentials, and activity under your account. You must notify us promptly of suspected misuse. Google, Meta, TikTok, Stripe, and other integrations are optional third-party services governed by their own terms. TempoWeb Studio is independent from and is not endorsed by those providers. You may disconnect an integration at any time, but doing so may disable related features.
4. Customer responsibilities
- Provide lawful, accurate, and timely content, access, approvals, and feedback.
- Own or have permission to use all supplied text, images, trademarks, data, and other materials.
- Review deliverables and report material issues within the agreed review period.
- Maintain lawful notices, permissions, and business practices for your own website or system after delivery.
5. Acceptable use
You may not use the service to violate law or third-party rights; distribute malware; scrape or access accounts without permission; spam or mislead others; interfere with security or availability; reverse engineer restricted parts of the service; upload illegal, infringing, hateful, exploitative, or deceptive content; or use provider data outside the permissions and user-facing purpose for which it was authorized.
6. Fees, payment, cancellation, and refunds
Prices exclude VAT unless stated otherwise. Payment milestones and due dates appear in the offer or checkout. Third-party fees and work outside scope may be charged separately with notice. Deposits reserve capacity and are non-refundable once work or procurement has begun, except where mandatory law says otherwise. Late payment may pause delivery or access. Consumer cancellation rights, where applicable, may be affected when you expressly request that digital or custom work begin during the withdrawal period.
7. Intellectual property
You retain ownership of materials you provide and grant us a limited licence to use them to deliver the services. Unless a project agreement says otherwise, ownership of custom final deliverables transfers after full payment. TempoWeb Studio retains its pre-existing tools, templates, know-how, generic components, and open-source materials; you receive the licence needed to use them within the deliverable. Third-party assets remain subject to their licences. We may show non-confidential completed work in our portfolio unless agreed otherwise in writing.
8. Privacy and platform data
Our Privacy Policy explains our data practices. You must use connected-platform data only as allowed by the relevant provider, the permissions granted by users, and applicable law. You must not sell, unlawfully profile, or disclose data obtained through Google, TikTok, or another integration.
9. Suspension and termination
You may stop using the service at any time and may request account deletion. We may suspend or terminate access for material breach, non-payment, security risk, unlawful use, or provider-policy violations. Where reasonable, we will give notice and an opportunity to cure. Accrued payment duties and provisions intended to survive termination remain effective.
10. Disclaimers and liability
We provide services with reasonable care and skill. Except for express commitments and rights that cannot lawfully be excluded, services are provided “as is”; we do not guarantee uninterrupted availability, specific search rankings, revenue, platform approval, or continued availability of third-party services. To the fullest extent permitted by law, neither party is liable for indirect or consequential loss. TempoWeb Studio’s aggregate liability arising from a claim is limited to fees paid for the affected service during the preceding twelve months. These limits do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or liability that cannot legally be limited.
11. Governing law and contact
Dutch law governs these Terms. Courts competent under Dutch law have jurisdiction, without limiting mandatory consumer rights. Before filing a claim, please contact us so we can try to resolve it.
